These Terms of Service ("Terms") explain the conditions for using zhithera.shop (the "Website") and purchasing from our store. The Website is operated by Zhithera., Limited ("Zhithera", "we", "us").

Please read these Terms carefully. By browsing the Website, creating an account, or placing an order, you agree to be bound by them. If you do not agree, please do not use the Website.

These Terms contain an arbitration agreement and a waiver of jury trial and class action rights (section 13). Please read that section carefully.

1. About our products

1.1 What we sell

Zhithera designs and sells aromatherapy diffusers and the essential oils and fragrance oils used with them. Our devices use Advanced Micro-Mesh Atomization to disperse compatible oils as a fine mist, without adding water or applying heat.

Our oil collections include pure botanical essential oils and designer fragrance oils. They offer different scent profiles for your space and are intended for diffusion in compatible Zhithera devices. Refer to the product page and supplied instructions for compatibility and use.

1.2 Intended use

Zhithera products are designed for aromatherapy and home fragrance: adding scent to everyday spaces, from the home and workspace to hospitality settings. Aroma is a personal sensory experience; intensity and preference vary with the oil, setting and environment.

Zhithera products are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or condition. Nothing on the Website should be read as a health claim or as medical advice. If you have a health concern, please speak to a qualified professional.

1.3 Safety

Please follow the instructions supplied with your product. In particular:

Oils are for diffusion only. Do not apply them to skin and do not swallow them.
Keep devices and oils out of reach of children and pets.
If you are pregnant or nursing, have a respiratory condition, or have known allergies or sensitivities, seek professional advice before use.
Use the device in a ventilated space and avoid prolonged, continuous operation in a small enclosed room.
Response to aroma varies from person to person. Stop using the product if you experience discomfort.
Use only Zhithera cartridges and oils. Damage caused by incompatible third-party liquids is excluded from warranty coverage, as explained in the Refund Policy.

1.4 Product information

We work to keep descriptions, images and specifications accurate. Colours may vary between screens, and packaging and specifications may be updated. Where a material error affects an order you have placed, we will contact you before dispatch and offer you the choice of proceeding, amending, or cancelling.

2. Eligibility and your account

2.1 Age

You must be at least 18 years old, or the age of majority where you live if that is higher, to place an order or hold an account. By ordering you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms.

Zhithera products are household fragrance products and should be used by adults. Devices and oils should be kept where children and pets cannot reach them.

2.2 Registration

Some features require an account. You agree to provide accurate information and to keep it current. You are responsible for keeping your password confidential and for activity that takes place under your account. Tell us promptly if you believe your account has been used without your permission.

2.3 Suspension and closure

We may restrict, suspend or close an account where we reasonably believe these Terms have been breached, where activity appears fraudulent, or where we are required to do so by law. You may close your account at any time by contacting us.

3. Orders and pricing

3.1 Forming a contract

Your order is an offer to buy. A contract is formed when we send you a dispatch confirmation. Until then we may decline or cancel an order — for example where stock is unavailable, where a price or description was materially wrong, or where we are unable to complete required verification.

3.2 Prices, taxes and duties

Prices are shown in the currency selected at checkout and may change without notice, though changes will not affect an order already confirmed for dispatch.

Import duties, customs charges and local taxes may be levied by the destination country. Unless the checkout states that duties are prepaid, these charges are payable by you and are not included in the price or the shipping fee.

3.3 Payment

Payments are handled by third-party payment providers. Zhithera does not store full card numbers. By submitting payment details you confirm you are authorised to use the payment method.

4. Shipping and delivery

Zhithera ships internationally. The fulfilment location and available services depend on your address and stock availability. Please refer to our Shipping & Delivery policy and the options shown at checkout for your order.

The dispatch origin can affect transit time, duties and applicable local requirements. Available shipping options and costs are calculated at checkout.

Delivery estimates are estimates, not guarantees. Carrier delays, customs inspection, weather and local events are outside our control. Full detail is set out in our Shipping & Delivery policy.

5. Returns, refunds and warranty

Returns are accepted within 30 days of delivery on unused devices in original packaging. Opened oils, cartridges and reservoirs are consumable goods and are excluded from change-of-mind returns. Arrival defects are handled under the Refund Policy. Zhithera diffusers and charging bases carry a 365-day replacement service for confirmed manufacturing or material defects under normal use.

6. Acceptable use

You agree not to:

Use the Website for any unlawful purpose or in breach of any applicable regulation;
Resell Zhithera products as an authorised dealer without our written agreement;
Attempt to gain unauthorised access to the Website, its servers or other accounts;
Introduce malware, or use scrapers, bots or automated means to harvest content or place bulk orders;
Interfere with the operation of the Website or place unreasonable load on it;
Misrepresent Zhithera products, including by attributing medical or therapeutic effects to them.

7. Intellectual property

The Website and its content — including text, images, video, product photography, graphics, logos, the Zhithera name, and the design of our products and packaging — are owned by or licensed to Zhithera and are protected by copyright, trade mark, design and other laws.

You may view and print content for your own personal, non-commercial use. Any other use, including reproduction, republication, distribution or commercial exploitation, requires our prior written permission.

8. Reviews and submissions

If you submit a review, image, comment or other material, you grant Zhithera a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt and display it in connection with our business.

You confirm that the material is your own or that you have the right to submit it, and that it is not unlawful, misleading or offensive. We may remove submissions that breach these Terms — including those that make health or medical claims about our products.

9. Third-party links and services

The Website may link to third-party sites and may embed third-party services such as payment, analytics and customer messaging tools. Those services are operated independently under their own terms and privacy practices. Zhithera is not responsible for their content or conduct.

10. Disclaimers

The Website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Zhithera disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Website will be uninterrupted, timely, secure or error-free, or that defects will be corrected.

This section does not exclude the product warranty described in our Refund Policy, and does not exclude any liability that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent permitted by law, Zhithera and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Website or our products.

Where liability cannot be excluded, our total aggregate liability arising out of or relating to an order is limited to the amount you paid for that order.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded under applicable law.

12. Indemnity

You agree to indemnify and hold harmless Zhithera and its officers, employees and agents from any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Website, or your violation of any law or third-party right.

13. Governing law and dispute resolution

13.1 Governing law

These Terms and any dispute arising out of or in connection with them are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions.

13.2 Informal resolution first

Most concerns can be resolved quickly. Before starting formal proceedings, please contact us at [email protected] and allow us 30 days to respond.

13.3 Arbitration

Any dispute that cannot be resolved informally shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under its administered arbitration rules in force at the time the notice of arbitration is submitted, and governed by the Arbitration Ordinance (Cap. 609) of the laws of Hong Kong. The seat of arbitration shall be Hong Kong and the language shall be English, unless we agree otherwise.

13.4 Individual basis

Disputes will be resolved on an individual basis. To the extent permitted by law, you and Zhithera waive any right to a jury trial and to participate in a class, collective or representative action.

13.5 Your local rights

If you are a consumer, this section does not deprive you of the protection of the mandatory consumer law of the country where you live, and does not remove any right you have to bring proceedings in your local courts where that right cannot be waived. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

14. Changes to these Terms

We may update these Terms from time to time. The revised version takes effect when posted, and the "last updated" date at the top will change. Where a change is material we will take reasonable steps to bring it to your attention. Orders already confirmed are governed by the Terms in force when they were placed.

15. General

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours in connection with a merger, acquisition or sale of assets.

These Terms, together with our Refund Policy, Shipping & Delivery policy, Privacy Policy and Cookie Policy, form the entire agreement between you and Zhithera in relation to the Website.
